Stylist Programme Terms & Conditions

Welcome to Kettlewell! Thank you for joining our Affiliate program.

This Affiliate Agreement is entered into between Kettlewell Colours Ltd ("Kettlewell", "we", "us", “Merchant”) and the Affiliate ("you"), who refers customers to Kettlewell Colours Ltd. This Agreement shall be governed by the laws of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales.

By participating in the Program, the Affiliate agrees to use the Program in the manner specified in, and are bound by, these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety you are not authorised to register as an Affiliate or participate in the Program in any manner.

 

1. Approval or Rejection of the Registration

We reserve the right to approve or reject any Affiliate Program Registration in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Registration.

 

2. Affiliate Links and Coupon

The Affiliate link is automatically generated, but you can also generate an affiliate link for a specific product or collection. Where a customer clicks more than one affiliate referral link prior to placing an order, commission shall be attributed on a last-click basis. This means the commission will be paid to the Affiliate whose referral link was most recently clicked before the order was completed.

You may be assigned a coupon code, with details and usage provided on the Dashboard. If a customer clicks on both the affiliate link and uses a coupon code, you will only receive the commission once.

The Affiliate may also advertise the Merchant website on offline or online channels such as Facebook or Instagram.

 

3. Commissions and Payment

Refer any customer to make a purchase on the Kettlewell website and you will get a commission amount which is calculated based on our Commission structure. Commission is calculated on the total order value (excluding any shipping costs). If the order is subsequently refunded, cancelled or charged back, then no commission will be payable on that order or part of the order that was refunded or cancelled.

For an Affiliate to receive a commission, you need to specify your payment details in the Settings.

Commission are paid every 60 days in GBP. The Payment schedule will be detailed on Affiliate Guide page.

Payments will only be sent for transactions that have been successfully completed.

The Commission Auto Reset Period renews on 1^st July each year.

Use of the Affiliate Program is subject to a fair use policy which gives Kettlewell the right to review each referral order. Affiliates must not generate commissions through fraudulent transactions, automated means, misleading advertising, spam, cookie stuffing, or any activity intended to artificially inflate commissions.

Kettlewell reserves the right to withhold, reverse or cancel commissions where it reasonably believes that a transaction is fraudulent, abusive, violates these Terms, or is subsequently refunded, cancelled or charged back.

Status of the commission is displayed in Commission tab and any paid commission will be listed on Payment tab. Transactions that result in charge backs or refunds will not be paid out.

We reserve the right to change the Commission structure at any time.

 

4. Marketing tool

Kettlewell may share promotion media such as banners, logos or specific promotions to you through Marketing tool tab. You can download the media or get the HTML embed code in order to share on affiliate channels. Kettlewell grants Affiliates a limited, non-exclusive, revocable licence to use approved marketing materials solely for the purpose of participating in the Affiliate Program.

 

5. Cookies

We use a cookie to track people who have clicked on your link, so they need to be using cookies for us to track them. If a customer doesn’t allow cookies or clears their cookies, then we cannot track their orders and we cannot pay commission on their activity.

The number of Cookies days is set on the Affiliate registration form. The tracking day will start from the time a customer clicks on the Affiliate’s link or uses the coupon. Within the cookie time, every order made by this customer at the Merchant website will automatically result in commissions to the Affiliate, even if they don’t click on the Affiliate link.

Tracking and processing of personal data in connection with the Affiliate Program is carried out in accordance with Kettlewell's Privacy Policy and Cookie Policy.

 

6. Removal or Termination

If an Affiliate wishes to be removed from the Affiliate Program, they can do so by contacting: stylists@kettlewellcolours.com.

Kettlewell may suspend or terminate an Affiliate's participation in the Program at any time, with or without notice, where it reasonably believes the Affiliate has breached these Terms. Approved commissions accrued prior to termination will remain payable in accordance with these Terms. Any commissions arising after termination shall not be payable.
